Judicial review (JR) is a legal challenge to how the Home Office made a decision, not a second look at your evidence. For most people refused a UK visa from Pakistan it is a last resort: first check whether you have a right of appeal or administrative review, and whether a stronger fresh application would be quicker. If JR is the right path, the Upper Tribunal must receive your claim within 3 months of the decision, and you will need a UK solicitor.
Your four options after a refusal
Your refusal letter tells you whether you have a right of appeal or can ask for administrative review. Read it carefully before you do anything else.
| Option | When it applies | Deadline | What is examined |
|---|---|---|---|
| Appeal to the First-tier Tribunal | When the refusal is of a human rights claim (for example, most spouse and family visa refusals), a protection claim or an EU Settlement Scheme application | 28 days from getting the decision | A judge looks again at the facts and evidence |
| Administrative review | Refusals on the routes listed in Appendix AR, such as Student and Skilled Worker. Visit visas and family visas are not covered | 28 days from getting the decision; fee £80 | Whether the caseworker made an error; new evidence is usually not considered |
| Judicial review | No appeal or administrative review is available, or administrative review has been completed, and the decision was unlawful, irrational or unfair | The Upper Tribunal must receive it within 3 months of the decision | The lawfulness of the decision, not the merits |
| Fresh application | Any refusal, especially where your evidence was weak or missing | None | A new decision on a new application |
What judicial review actually is
JR in immigration cases is heard by the Upper Tribunal (Immigration and Asylum Chamber). The judge does not decide whether you should get a visa. They decide whether the Home Office acted lawfully. Typical grounds are that the decision-maker:
- ignored evidence you did submit, such as bank statements or an employment letter;
- applied the wrong rule or misread the rule;
- reached a conclusion that no reasonable decision-maker could reach on the evidence;
- treated you unfairly, for example by relying on a concern you were never given a chance to answer.
It is not a way to add documents you forgot, or to argue that the officer should have given more weight to your ties to Pakistan. If the refusal is simply that your evidence was thin, JR will not help.
If you win, the court usually quashes the decision and the Home Office must decide your application again. Winning does not mean the visa is granted.
The JR process step by step
- Get advice quickly. A solicitor reads the refusal letter and your original application to see if there is a legal error.
- Pre-action letter. Your solicitor writes to the Home Office setting out the error and asking it to withdraw the decision. The Home Office normally has 14 days to reply. Many cases end here, with the Home Office agreeing to reconsider.
- Filing the claim. If the reply is unsatisfactory, the claim is filed with the Upper Tribunal, usually through the HMCTS e-filing service or on form UTIAC1. The tribunal must receive it within 3 months of the decision. The application fee on GOV.UK is currently £179.
- Permission. A judge decides on the papers whether the case can go ahead. If permission is refused, you can ask for an oral hearing to reconsider (a further fee applies).
- Full hearing. If permission is granted, a further fee is payable and the case is argued at a hearing. The judge then decides whether the decision was unlawful and what remedy to give.
Tribunal fees are only part of the cost. Legal fees are usually much higher, and if you lose you can be ordered to pay the Home Office’s legal costs.
Why you need a UK solicitor
GOV.UK does not make legal representation compulsory, but JR is a formal court process in England with strict rules, deadlines and costs risks. It needs a solicitor, or a barrister, who is qualified in the UK and experienced in immigration JR. A visa consultant in Pakistan cannot conduct JR for you.
What we can do is look at your refusal letter and tell you honestly whether a fresh application, an appeal or a legal challenge is the better route, and what to fix.
Refused a visit visa from Pakistan? Read this first
Visit visa refusals carry no right of appeal (family visit appeals were abolished in 2013) and are not eligible for administrative review. That leaves JR or a fresh application.
For most visitors, a fresh application that answers every point in the refusal letter is faster and cheaper. JR is usually worth discussing only when the refusal is plainly wrong in law and the consequences are serious, for example a finding that you used deception, which can lead to future applications being refused for years.

Common mistakes we see from Pakistan applications
- Missing the 3-month deadline. People wait for an agent to “get back to them” and the time runs out. Late claims need a good explanation and may be rejected.
- Treating JR as an appeal. Sending new documents to the tribunal does not work. The question is whether the decision was lawful on what the Home Office had.
- Reapplying with the same file. If you choose a fresh application, fix every issue in the refusal. Our sister site’s guide on your chances after a refusal explains how.
- Not declaring a previous refusal. Every later UK application asks about refusals. Leaving one out can be treated as deception.
- Paying for “guaranteed” challenges. Nobody can guarantee a JR outcome or a visa.
FAQ
Can I apply for judicial review of a visit visa refusal?
Yes, in principle, if the decision was unlawful. In practice most visit visa refusals are better handled by a stronger fresh application, because JR is slow, costly and does not itself grant a visa.
How is an appeal different from judicial review?
An appeal lets a judge look again at the facts and evidence, and it is only available for certain decisions, such as refused human rights claims in family cases. Our sister site’s UK immigration appeal guide covers this. JR looks only at whether the decision was made lawfully.
Can I make a new application while considering JR?
Yes, you can reapply at any time. Tell your solicitor first, because a new decision can affect whether the JR is still worth pursuing.
Does winning a JR mean I get the visa?
No. Usually the decision is quashed and the Home Office decides your application again.
